250名中國投資者投資美國移民項目，被騙1.45億美元

美國當地時間2月6日，美國證券交易委員會(SEC)在其網站上宣布，美國商人Sethi謊稱投資者購買其公司股份便可快速獲得移民美國的機會，詐騙250余名投資者1.45億美元投資和1100萬美元管理費用，這些投資者大多來自中國。SEC已對Sethi及其兩家公司的資産進行了凍結，保留了上億美元的投資款項，但投資者被騙的1100萬美元管理費用已有九成被花掉。

Sethi創建的兩家公司分別爲芝加哥會議中心(ACCC)及芝加哥洲際區域中心信托(IRCTC)，Sethi此前謊稱他的公司將在芝加哥奧黑爾機場附近融資建設“世界上第一個零碳排放鉑金LEED認證”的酒店和會議中心，投資者只要購買ACCC的股份，就可以通過EB-5移民投資者試點計劃快速獲得移民美國的機會。

EB-5計劃的主要內容是，如果海外投資者投資100萬美元(或50萬美元在失業率較高的“特定就業領域”)于創造或維持10個美國工人崗位的項目，他們就有可能獲得美國綠卡。

SEC表示，Sethi與他的公司欺騙中國投資者稱他們已經得到所有必要的建設許可，幾家酒店連鎖企業也加入了這一項目。他們還向美國公司身份和移民服務局提交了僞造的文件，試圖取得項目許可以及投資者的臨時簽證。

SEC指控稱，Sethi向超過250名投資者欺詐銷售超過1.45億美元證券，並收取了1100萬美元管理費用，而這些投資者主要來自于中國。Sethi曾承諾，如果簽證不成功將退回收取的管理費，但Sethi及其公司已經花掉了管理費的90%。其中，超過250萬美元已經進入Sethi在香港的個人賬戶。

“好消息是，我們幹預得比較早，資産凍結保留了幾乎所有投資款項。”SEC執法部門的副主任斯蒂芬·L·科恩說。根據美國證券與交易委員會起訴書中的指控，Sethi及其兩家公司違反了1933年證券法第17(a)條及10(b)條。除了法院授予的臨時限制令及資産凍結外，SEC的申訴尋求永久禁止令以及其他的金錢禁令。
